Terms & Conditions Agreement

THIS AGREEMENT (“Agreement”) is a legally binding contract between the User, any website visitor (“User”), any paid client (“Client”), and Massimodates, a company duly incorporated under the laws of the State of Colombia, offering services to assist the Client in online dating. Massimodates exclusively owns and operates www.massimodates.com (the “Website”). The terms and conditions outlined in this Agreement apply to the use of the Website and all services (“Services”) provided by Massimodates.

By accessing the Website and utilizing the Services, the User and the Client agree to be bound by the terms and conditions of this Agreement and Massimodates’s Privacy Policy. This agreement remains in effect as long as the User or the Client continues to use the Website and Services.

If the User or the Client disagrees with this Agreement, they should refrain from using the Website or Services, exit immediately, and cease viewing any web pages.

Modifications

Massimodates reserves the right to amend or modify the terms and conditions of this Agreement at any time without notice. Massimodates may notify the User or the Client of any changes via email under certain circumstances. However, it is the User’s or the Client’s responsibility to regularly check for updates, amendments, or modifications to the Massimodates terms and conditions.

Future changes will not apply retroactively. Continued use of Massimodates’s Services constitutes acceptance of any amendments, modifications, or changes, and agreement to be legally bound by them. If the User or the Client does not accept any amendment, modification, or change, they should immediately cease using Massimodates’s Services.

Eligibility

To use the Website or its Services, the User and the Client must be eighteen (18) years of age or older (or the age of majority in their jurisdiction). By visiting or using the Website or Services, the User and the Client affirm that they meet the age requirement and have the right, authority, and capacity to agree to and be bound by the terms and conditions of this Agreement.

All Clients must provide accurate and truthful personal information. Clients are responsible for updating Massimodates with the most up-to-date information. Providing false information may result in the cancellation of the Client’s order and the suspension of their account.

Clients and Users must comply with all applicable local, state, national, and international laws. Massimodates is not liable if such laws restrict the Client’s or the User’s use of the Website. Massimodates makes no representations or warranties regarding the legal right of Clients or Users to participate in any service or product offered on the Website.

By using or registering to use the Website or Services, the User and the Client represent and warrant to Massimodates that they have never been convicted of a felony or an indictable offense and are not required to register as a sex offender.

Massimodates does not automatically conduct criminal background checks on its Clients or their potential matches unless specifically requested in writing by the Client. Massimodates reserves the right to conduct criminal background checks at any time, depending on the availability of public records, to confirm compliance with the terms and conditions of this Agreement.

The Client warrants that they have full rights to pictures submitted to Massimodates and grant permission for Massimodates’s distribution of these pictures to third parties.

User Obligations

Our services are not intended for individuals under 18. Minors are not eligible to use our services, and we discourage the submission of personal information by individuals under the age of 18.

Clients must update Massimodates to ensure information is accurate and not in violation of the specified terms. The User or the Client agrees not to use, sell, or distribute Massimodates’s proprietary information in any way.

The User and the Client agree not to provide email addresses of other people to Massimodates or publish/send any information referring to other people without obtaining their prior consent. Any disruptive actions, including the use of malware, viruses, or mass mailings, are strictly prohibited.

Unauthorized access attempts to any part of the Services or related equipment are forbidden. The User and the Client must use the Services only for the purposes outlined in these Terms & Conditions. Any breach of these obligations constitutes a serious violation of this Agreement.

Clients must comply with guidelines, requirements, and reasonable requests or instructions provided by Massimodates in connection with the Services. The Client must promptly report any inappropriate behavior in connection with the Services.

Functioning of Site and Services

Massimodates reserves the right to suspend Services at any time for repair, maintenance, improvement, or technical reasons without notice. Massimodates may change the Services provided, provided such changes do not materially affect the quality of the Services.

Service Rules and Obligations for Clients and Potential Matches

The Client agrees to comply with specified rules when purchasing Services from Massimodates. Failure to respect these rules will result in a breach of contract, canceling Massimodates’s obligations and liabilities.

The Client is expected to honor scheduled calls with their Matchmaker. Rescheduling or not attending incurs a $50 rebooking fee.

Directly contacting Selected Candidates without prior approval from Massimodates is prohibited.

The Client must have a schedule allowing for sufficient time to be present at a date. The Client must inform Massimodates at least 48 hours before a set date if they wish to cancel or reschedule.

While Massimodates can estimate average results for each dating package, results are not guaranteed. Massimodates is not obligated to offer partial or full refunds for not achieving certain results or for any other reason.

Massimodates does not conduct criminal background or identity verification checks on its Potential Matches unless explicitly requested by the Client. Users are responsible for their interactions with Potential Matches.

Users should exercise caution and take safety precautions when communicating with or meeting new people. Massimodates is not responsible for the conduct of any Client or Potential Match.

Clients agree not to initiate chargebacks without attempting amicable resolution. Chargebacks constitute a material breach, allowing Massimodates to dispute, appeal, or take legal action. In case of non-payment, Massimodates may suspend or close the Client’s Account and retain the right to use the dating profile at its discretion.

Massimodates may refuse Services to any prospective or active Client for reasons such as unreasonable expectations, doubts about identity or criminal background, or failure to adhere to agreed-upon rules. A refund will not be provided if the user does not comply to the rules stated above.

Intellectual Property

Contents on the Website are protected by intellectual property rights. Users and Clients do not have the right to use or license any of these intellectual property rights. Modifying, reproducing, republishing, copying, posting, uploading, transmitting, or distributing Website information and materials is strictly prohibited.

Users are permitted to print and download portions of the information for personal use, provided they do not alter or delete any copyright or proprietary notices. Trademarks, trade names, or service marks displayed on the Website may be the property of Massimodates or affiliated entities. Unauthorized downloading, re-transmission, or modification of trademarks and contents may violate federal common law, trademark, or copyright laws.

Safety and Security

Massimodates does not provide.

Internet Access or Electronic Communication Services

When meeting others through Services, the Client must take appropriate precautions, and any meetings are at their own risk.

Clients must immediately notify Massimodates of any security breaches, including loss, theft, misuse, or unauthorized disclosure of a username or password.

Third Party Rights

This section represents an agreement on behalf of Massimodates and its affiliates, giving them the right to assert and enforce provisions directly against Users or Clients.

Indemnification

All Website Users agree to indemnify and hold Massimodates and its affiliates harmless from losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement by any User or Client.

Dispute Resolution

Disputes between the User, the Client, and Massimodates will be initially resolved through amiable discussion/negotiation. If unresolved, disputes shall be submitted to binding arbitration under Colombian laws. Users agree to arbitration as the forum for dispute resolution when using Massimodates’s Services.

Termination/Cancellation

The User’s or the Client’s agreement to follow the terms and conditions remains in effect as long as they use the Website unless terminated earlier by Massimodates. Massimodates reserves the right to terminate a Client’s account at its discretion with immediate effect, notifying the Client via email.

Clients may cancel subscriptions within twenty-four (24) hours of billing without penalty. The Client agrees to the termination terms provided by Massimodates.

Applicable Governing Laws

This Agreement is governed by the laws of the State of Colombia without regard to its conflict of law provisions. Users agree that any cause of action arising out of or related to this Agreement or their use of the Website will be commenced within the statute of limitations set by Colombian laws.

Severability/Waiver

If any portion of this Agreement is deemed unlawful or unenforceable, it shall be reformed to reflect the parties’ intent or severed if reformation is not possible. Severance does not affect the validity of the remaining provisions. Massimodates’s failure to exercise any right or provision does not constitute a waiver.

Entire Agreement (Terms and Conditions)

This Agreement, along with other obligations and rules on the Website, constitutes the entire agreement between the User, the Client, and Massimodates. It cannot be individually modified by any person affiliated with the Website.
